These terms and conditions ("Terms") apply to participation in the CLICQUI x LULULEMON x FRAMEWORK Sweepstakes ("the Promotion").
 

1. Organizer
   CLICQUI, represented by Cynthia Mensah-Neglokpe, Paracelsusstraße 16, 80939 Munich ("Clicqui," "Organizer"), is the organizer of the Promotion. By participating in the Promotion, you agree to these Terms and Conditions. You are not obligated to purchase goods or products from the organizer to be able to participate in the Promotion. Purchasing goods or products does not increase the chances of winning.
    

2. Eligibility
   Eligible participants are individuals who reside in Germany and are at least eighteen (18) years old and fully legally competent at the time of participation, invited by CLICQUI x LULULEMON x FRAMEWORK. The organizer reserves the right to verify participants' eligibility and reserves the right, where legally permissible, to request information necessary for this purpose. The organizer also reserves the right to verify whether the winner is of legal age. Should the organizer require appropriate proof and it is not provided within the prescribed period, the organizer has the right to exclude you from participating or receiving a prize. The organizer may disqualify individuals who, in their opinion, are not eligible to participate, violate these terms, or behave illegally or inappropriately, or attempt to do so, potentially compromising the fairness and proper conduct of the Promotion.
    

3. Promotion
   Period The Promotion begins on October 27, 2023, at 00:01 CET ("Start Date") and ends on October 30, 2023, at 23:59 CET ("End Date"), with this period being the "Promotion Period." To participate in the Promotion, you must meet all participation and eligibility requirements of these Terms by the End Date.
    

4. How to Participate
   To participate in the Promotion, the following conditions must be met: Eligible individuals must have successfully registered for the sweepstakes via the landing page with CLICQUI within the Promotion Period. Participation in the sweepstakes by other means is not possible. Participation through sweepstakes clubs or other commercial service providers is prohibited. Participants must also refrain from any form of manipulation or attempts at manipulation, particularly in connection with access to, participation in, or conduct of the sweepstakes. Only one (1) entry per person is allowed. If a participant has already won once (1), they are excluded from further wins in this sweepstakes – any further ticket purchases by the person will not be considered. Entries not complying with these terms are invalid and will not participate in this Promotion.
    

5. Prize
   From all the received sweepstakes registrations, eight (8) winners will be selected at random ("Prize Winners"). The Prize Winners will receive a Mega Reformer class at Framework Berlin, followed by lunch, as well as a Lululemon leggings. The event date for this is November 4, 2023, at 13:30. A cash payout of the prize is not possible. You agree that the organizer and all other companies involved in the Promotion, as well as their representatives, do not make any express or implied warranties, representations, or guarantees regarding the quality, conditions, suitability, or marketability of a prize and are in no way responsible for these. Any images of the prizes are for illustrative purposes only.
    

6. Selection and Notification of the Winner
   The Prize Winners will be determined at the end of the Promotion Period by a random draw using an electronic random selection process. The Prize Winners will be notified by CLIQUI via email and asked to confirm acceptance of the prize by providing details in response to such notification within ten (2) calendar days of notification. If the Prize Winner does not confirm acceptance within the deadline, the prize is considered forfeited, and the organizer will as soon as possible randomly select another Prize Winner. The prize or part of the prize is not transferable or exchangeable and cannot be redeemed for cash. The winner has no right to compensation if they are unable to accept the prize. The Prize Winner is responsible for all tax matters related to accepting the prize and should seek independent financial advice before accepting the prize. Any additional costs arising from accepting the prize are solely the responsibility of the winner; the organizer accepts no liability for additional costs. The organizer reserves the right to replace the prize or part of the prize with an alternative prize of equal or higher value. The odds of winning depend on the number of eligible entries received during the Promotion Period.
    

7. Personal Data
   Individuals participating in the Promotion may be asked to provide certain personal data such as name and email, as well as other information requested by the organizer. The legal basis for processing your personal data during the promotion is the fulfillment of the organizer's contractual obligations according to these terms. The organizer may disclose your personal data to suppliers, subcontractors, freight carriers, or co-organizers such as dealers to conduct the Promotion or make the prize available to you. An alternative legal basis for processing your personal data is your consent or the legitimate interest of the organizer. Please read the  Privacy Policy carefully to understand how CLICQUI collects, uses, and discloses customer information, how you can update or change your personal data, and how we communicate with you. All personal data provided in connection with the Promotion will be used, disclosed, and retained as described in the Privacy Policy.
    

8. Applicable Law
   These Terms (including all non-contractual disputes or claims arising out of or in connection with them) are subject to German law and shall be interpreted accordingly. In any legal action or other legal proceedings concerning any matter or thing in connection with these Terms, you submit to the non-exclusive jurisdiction of the courts of Germany, notwithstanding any right you may have as a consumer to bring any disputes in connection with this Promotion before the courts and jurisdiction of your habitual residence.
    

9. Liability of the Organizer and Cancellation or Modification of the Promotion
   The organizer is not responsible for technical failures, malfunctions, issues with or damage to equipment (including, but not limited to, wireless devices, websites, wireless networks, servers, computer hardware or software) occurring during the Promotion or resulting from your participation in the Promotion. The organizer reserves the right, where not expressly prohibited by law, to cancel, suspend, modify, or terminate the Promotion if objective reasons exist, including but not limited to, if fraud or another technical problem impairs the administration, security, or proper conduct of the Promotion, as determined by the organizer in its sole discretion. In the event of such cancellation, modification, suspension, or termination, you hereby waive any claims against the organizer. These terms do not limit the organizer's liability for death or personal injury caused by the organizer's negligence or for fraud. However, the organizer is not liable to participants or winners for losses that were not foreseeable to either the organizer or participants at the time of participation or any losses that are not caused by the organizer's breach of these terms. The organizer is not liable for the loss, damage, or delay of a prize due to circumstances beyond the organizer's control.
    

10. Other Provisions
    These Terms are final. There are no legal claims to participation or implementation of the Promotion. These Terms are legally binding, and there is no right to appeal the organizer's decision regarding any aspect of the Promotion. The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
